FailGold Dataset License

This license applies to every dataset pack you (“Licensee”) purchase from FailGold on failgold.com. By completing a purchase you agree to it on behalf of the organization named in your buyer account.

1. What you get

A non-exclusive, worldwide, perpetual, non-transferable license to use the traces in the packs you purchased (“the Data”) to evaluate, test, train, fine-tune and improve AI systems, and for internal research and product development. Other organizations may license the same traces.

2. What you may not do

• Redistribute, resell, sublicense or publish the Data, or any substantial part of it, as a dataset. Publishing short excerpts or aggregate statistics in research papers, model cards or reports is allowed.
• Attempt to re-identify contributors or any person mentioned in the Data, or combine it with other data for that purpose.
• Use the Data to harass, profile or make decisions about individuals.
• Share download links or account access with other organizations.

3. About the Data

Traces are submitted by users of the FailGold extension, scrubbed of personal information and secrets automatically (in the browser and again on our servers), and reviewed by people before they're sold. Automated scrubbing is not perfect. If you find personal information or a secret in the Data, don't use it: report it through our contact form and delete the affected record. We'll provide a corrected version.

Screenshot links in delivered files expire after 7 days; you can download the pack again from your buyer account for fresh links.

4. Payment and refunds

Prices are shown before checkout and charged through Stripe. If a pack is materially different from its description, contact us within 14 days of purchase for a refund or replacement. Refunded packs must be deleted, and your license to them ends.

5. Contributors

Contributors receive 70% of the revenue from each trace you license. Contributors are not parties to this license and make no promises to you.

6. No warranty; liability

The Data documents failures of AI systems and is provided “as is”, without warranties of accuracy, completeness or fitness for a particular purpose. To the extent permitted by law, FailGold's total liability relating to a purchase is limited to the amount you paid for it, and neither party is liable for indirect or consequential damages.

7. Termination

If you breach this license, we may terminate it by notice; you must then stop using and delete the Data. Sections 2, 3, 6 and 7 survive termination.

8. Changes

New versions of this license apply only to purchases made after they're published. Each purchase records the version you agreed to. Questions: contact us.
